These Terms of Use (the "Terms") set out the conditions for using "APOUL Calendar" (the "App"), an iPhone and iPad app provided by APOUL ("we" or "us"). By using the App, you agree to these Terms. If there is any difference between the Japanese and English versions, the Japanese version prevails.
1. Scope
These Terms apply to all matters between you and us regarding the use of the App.
Apple's App Store terms also apply to downloading and purchasing the App.
2. Where your data is stored
The schedules, notes, background images and settings you enter are processed and stored on your device (iPhone or iPad) and are never sent to us.
Because we do not keep your data, we cannot recover data lost through device failure, loss, or deleting the App. Please use the App's backup feature to keep a copy of important schedules.
3. Sharing features
Schedules you send by link, file, nearby exchange or share group are saved on the recipient's device. We cannot withdraw them after they are sent.
Please check the recipient and the content yourself. Do not send other people's schedules or personal information without their consent.
Please manage the passphrase of your share groups yourself. Anyone who knows the passphrase can receive that group's schedules.
4. Premium plan
The Premium plan is an auto-renewable subscription through Apple. The price and period are shown on the App Store screen at the time of purchase.
Payment is charged to your Apple ID. The subscription renews automatically for the same period unless cancelled at least 24 hours before the end of the current period.
You can cancel from Subscriptions under your Apple ID in the Settings app. After cancelling, you can keep using the plan until the end of the current period.
Refunds are subject to Apple's policies. We cannot issue refunds directly.
The free version shows ads. No ads are shown while you are subscribed to the Premium plan.
Cancelling does not automatically delete backup copies you have already made.
5. Prohibited conduct
When using the App, you must not:
- break the law or act against public order and morals
- infringe the rights or interests of others
- modify or analyze the App to use it improperly
- interfere with the operation of the App
6. Disclaimer
We do not guarantee that the App will work without problems on every device or in every situation.
We are not liable for damages arising from your use of the App, except where caused by our intent or gross negligence.
We have no control over how content you send is handled on the recipient's device.
7. Changes to or discontinuation of the App
We may change the App or stop providing it. If we stop providing it, we will announce this in advance in the App or on our website wherever possible.
8. Changes to these Terms
We may change these Terms when necessary. We will announce the new content and the date it takes effect in advance, in the App or on our website.
9. Governing law and jurisdiction
These Terms are governed by the laws of Japan.
Any dispute relating to these Terms or the App shall be subject to the exclusive jurisdiction of the Shizuoka District Court as the court of first instance.
